The DODO HOUSE Boutique (hereinafter referred to as the “Site”) is an e-commerce site accessible through the Internet at http://dodohouse.fr. It is open to any user of this network (hereinafter referred to as "Internet user"). It is edited by the company DODO HOUSE, Société par Action Simplifiée whose registered office is at 24 - 26 avenue Jean Jaurès C/o Cogesta 83120 Sainte-Maxime, registered in the Register of Commerce and Companies of FREJUS under the number 399 106 798. The Site allows DODO HOUSE to offer cosmetics and perfumes (hereinafter referred to as “Products”) for sale to Internet users browsing the Site (hereinafter referred to as “Users”).

The Site allows to order the Products of the brand DODO HOUSE immediately online via the Internet for a delivery to metropolitan FRANCE, ILE DE CORSE included, the DOM-TOM (Guadeloupe, Guyana, New Caledonia, Reunion Island, Martinique, Mayotte, French Polynesia, Saint-Barthélemy, Saint-Martin, Saint-Pierre-Et-Miquelon, Wallis-Et-Futuna), the PRINCIPAUTE OF MONACO and abroad.

For the purposes of this agreement, it is agreed that the User and DODO HOUSE will be collectively referred to as the “Parties” and individually referred to as the “Party”, and that the User who has validated an order will then be referred to as the “Buyer”. The rights and obligations of the User shall necessarily apply to the Buyer.

It is specified that the Products are intended for a personal use of the User, without any direct connection with the professional activity of the User. The User who wishes to purchase on the Site, declares to have full legal capacity. Any order for a Product proposed on the Site requires the express consultation and acceptance of these general conditions of sale, however, this acceptance is not conditional on a handwritten signature by the User. In accordance with the provisions of Articles 1316 to 1316-4 of the Civil Code, supplemented by Decree No. 2001-272 of 30 March 2001, made for the application of Article 1316-4 of the Civil Code and relating to electronic signature, it is recalled that the validation of the purchase order as specified in article 3.3. hereinafter, constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature.

The purpose of these general terms and conditions of sale is to define, exclusively by reason of the relations they establish on the Internet and only on the Site, the rights and obligations of the Parties arising from the online sale of the Products offered on the Site from France.

They determine all the steps necessary for the execution of an order and ensure the follow-up of this order between the parties.

DODO HOUSE may at any time update these general conditions of sale.

These conditions apply to the exclusion of any other document.

Product

The Products offered for sale by DODO HOUSE are those listed on the Site, on the day of the User’s consultation of the Site. Photographs illustrating the Products do not fall within the scope of the contract. If they were erroneous, the responsibility of DODO HOUSE cannot be assumed by this Chief.
The Products are offered within the limits of available stocks. In the event of unavailability of one of the Products, the Buyer shall be informed at the earliest opportunity. In the event that the unavailability of a product is found after the validation of the order, the Buyer will have the possibility, within thirty (30) days at the latest after their collection, cancel the order by requesting either the refund of the sums paid, or exchange the Product(s) unavailable, by e-mail.

DODO HOUSE does not incur any liability in the event of lack of stock or unavailability of products.

Price and payment

The prices of the Products are indicated in euros. They take into account the T.V.A. applicable on the day of the order. The prices indicated do not take into account the packing and delivery costs which will be invoiced in addition and will be specified to the User during the final validation of his order. 
DODO HOUSE reserves the right, which the User accepts, to modify its prices at any time but the Products will be invoiced on the basis of the rates in force at the time of the order registration, subject, however, to the availability of the said Products.

It is specified that any payment will be made immediately on the Internet. Unless the server is unavailable, the User can validate his order by Bank Card (Blue, Visa, Mastercard). The user will enter his card number, the expiry date of the card, the name of the cardholder and the visual cryptogram. Card payment is secured with 3D Secure technology.

Ordering process

The Site allows to order the DODO HOUSE Products immediately online via the Internet for delivery to metropolitan France, including the island of Corsica, the DOM-TOM (Guadeloupe, Guyana, New Caledonia, Reunion Island, Martinique, Mayotte, French Polynesia, Saint-Barthelemy, Saint-Martin, Saint-Pierre-Et-Miquelon, Wallis-Et-Futuna), the Principality of Monaco and abroad.

Orders paid by credit card are prepared on the same day (working days) if they are recorded before 2 pm, otherwise the following working day.

Orders are then sent by the usual postal services, and in particular by means of the "Colissimo followed" service under which the Post undertakes to deliver within 48 hours.
In any case, the order will be executed no later than thirty (30) days from the day following the validation of the order by the User.

The Products ordered by the Buyer will be delivered to the address indicated by the latter on the order form or deposited at the post office on which depends the delivery address mentioned by the Buyer, in case of absence of the recipient of the Products. In the latter case, the letter carrier will leave a notice of passage in the mailbox of the said recipient allowing to withdraw his parcel during the working hours of the post office, within a period of fifteen (15) days.

DODO HOUSE therefore declines any liability in the event of an excessive delivery time due to postal services, as well as in the event of loss of the Products ordered or the strike of the postal services. It is specified that the risks of transport are borne by the Buyer. In the event of a delay in delivery, the Buyer must notify this delay, as soon as possible to the customer service of DODO HOUSE, by e-mail to info.dodohouse@gmail.com, or by mail to DODO HOUSE, 24 – 26 avenue Jean Jaurès C/o Cogesta 83120 Sainte-Maxime. DODO HOUSE will then move closer to postal services so that an investigation can be carried out. The delay in a postal investigation can be long. In addition, it is specified that the ownership of the Products ordered will only be transferred to the Buyer at the total payment of the invoice price, including the delivery costs.

Upon receipt of the Products ordered, the Buyer shall verify the conformity of these Products. Any anomaly concerning the delivery (Product missing or broken, damaged parcel, ...) must be reported by the Buyer on the receipt presented to him by the Post Office at the time of delivery of the parcel and must be absolutely notified, DODO HOUSE Customer Service, by e-mail to info.dodohouse@gmail.com or by mail to DODO HOUSE, 24 – 26 Jean Jaurès Avenue C/o Cogesta 83120 Sainte-Maxime. Any claim made after 14 days will be rejected and DODO HOUSE will be released from liability.

DODO HOUSE will not be liable in the event of loss, incorrect address or delay in delivery of a product, insofar as the risks of transport that the Buyer chooses depend on it.

Right of withdrawal

The Purchaser has seven (14) working days to return, at its expense, the Product(s) it has ordered if the Purchaser(s) does not satisfy it. This period shall run from the date of delivery of the order. The Product(s) will be returned in its original packaging, condition and packaging and accompanied by the heel(s) at the bottom of the invoice or delivery note at the following address: DODO HOUSE – 24 - 26 Jean Jaurès Avenue C/o Cogesta 83120 Sainte-Maxime.

If the above conditions are fulfilled, DODO HOUSE will reimburse the Buyer, within thirty (30) days, the sums corresponding to the products acquired by it.

DODO HOUSE does not accept packages in due port.
Any risk related to the return of the product(s) is the responsibility of the Consumer.
However, it is specified that the shipping costs are borne by DODO HOUSE in the event that the return decision is the result of an error from DODO HOUSE (Non-compliant Product(s)).

Nominative informations

The identification information collected in connection with the remote sale is mandatory, since this information is necessary for the processing and delivery of orders and for the drawing up of invoices. This information is strictly confidential. Failure to provide information implies automatic rejection of the order. In accordance with the Data Protection and Freedoms Act, the processing of personal information collected on the Site has been the subject of a declaration to the National Commission of Data Protection and Freedoms. The User has a right to access, modify, rectify and delete data concerning him. To exercise this right, the User must send a simple letter to the consumer service DODO HOUSE – 24 - 26 avenue Jean Jaurès C/o Cogesta 83120 Sainte-Maximeoor an e-mail to info.dodohouse@gmail.com.

Cookies

The Site uses cookies. The cookie is a computer file, stored on the hard disk of the User’s microcomputer. It is intended to report a previous visit of the User to the Site. Cookies are only used by DODO HOUSE for the purpose of personalizing the service offered to the User. It cannot, under any circumstances, damage the data contained in the computer.
Most browsers automatically accept cookies, but they can also be configured to not accept them or to indicate the sending of cookies. We recommend that you do not disable this function, as it would prevent you from freely moving from page to page and benefiting from all the specificities of the Site.

Force majeure

No Party shall be liable for the total or partial non-performance of its obligations under this Contract, if such non-performance is caused by an event constituting force majeure. Events meeting the criteria laid down by the jurisprudence of the 2nd Civil Chamber of the Court of Cassation shall be considered as cases of force majeure. The Party invoking a force majeure event shall notify the other Party within five working days of the occurrence or threat of that event. The Parties agree that they will have to consult as soon as possible in order to determine together the modalities of execution of the order during the period of force majeure. 
After a period of one (1) month of interruption due to force majeure, DODO HOUSE may not honour the order, with the burden of reimbursing the Purchaser if necessary.

Partial non-validity

If one or more stipulations of these General Conditions of Sale are held to be non-validal or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.

Entire agreement

The present general conditions of sale and the order summary transmitted to the Buyer form a contractual whole and constitute the totality of the contractual relations between the Parties. In case of contradiction between these documents, the general conditions of sale shall prevail.

Applicable law - Competent authorities 

The sales of products of the company DODO HOUSE are subject to French law regardless of the country of residence of the Buyer and the place of placing of the Order. 
ANY DISPUTE RELATING TO THE EXISTENCE, INTERPRETATION, EXECUTION OR TERMINATION OF THE CONTRACT CONCLUDED BETWEEN DODO HOUSE AND THE PURCHASER, EVEN IN THE CASE OF MULTIPLE DEFENDANTS, SHALL, FAILING AN AMICABLE AGREEMENT, THE EXCLUSIVE JURISDICTION OF THE COMPETENT FRENCH COURTS PURSUANT TO THE RULES LAID DOWN BY THE FRENCH CODE OF CIVIL PROCEDURE.
